Drawing Rules

- Eligibility
The drawing (the “Drawing”) is open to legal residents and occupants currently residing in one of the homes managed by Imajn Homes, LLC dba Sparrow who are at least eighteen (18) years old at the time of entry. Employees of Imajn Services, LLC and other companies associated with the promotion of the Drawing, and their respective parents, subsidiaries, affiliates and advertising and promotion agencies as well as the immediate family (spouse, parents, siblings, and children) and household members of each such employee are not eligible. The Drawing is subject to federal, state, and local laws and regulations.
The Drawing Provider may, in its sole discretion, disqualify any person if it is determined that awarding a prize to such a winner might reflect negatively on Drawing Provider.
- Provider
The Drawing is administered by Imajn Services, LLC, located at 8390 E Via de Ventura Blvd., F-110, #303, Scottsdale, Arizona 85258 (the “Drawing Provider”).
- Agreement to Official Rules
Participation in the Drawing constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of the Provider, which are final and binding. Winning a prize is contingent upon being compliant with these Official Rules and fulfilling all other requirements set forth herein.
YOUR ENTRY AND THE PERSONAL INFORMATION COLLECTED FROM YOU IN CONNECTION WITH THIS DRAWING WILL BE SHARED WITH THE DRAWING PROVIDER.
You understand and agree that the information you provide will be used for marketing purposes by the Drawing Provider.
- Drawing Period
The Drawing begins on November 10, 2022 at 8:00 am MST and ends on November 18th, 2022 at 5:00 pm MST (the “Drawing Period”). Entries that are submitted before or after the Drawing Period will be disqualified. The sole determinant of time for the purposes of the Sweepstakes will be when the Entry is received by the applicable server.
No responsibility is assumed by Drawing Provider for lost, late, misdirected, or illegible Entries or for any computer, online, telephone or technical malfunctions that may occur.
All entries must be identifiable with a natural person by appropriate independent means. Potential winners may be requested to provide the Drawing Provider with proof that the potential winner is the individual associated with the winning entry. Submissions will be accepted for the duration of the Drawing using any of the following methods:
- How to Enter
Online: This method of entry will be available by following our Instagram page @sparrownowhomes.
Limit one (1) entry per person, per email address, and per household for the duration of the Drawing Period, regardless of method of entry. Entries received from any person, e-mail address, or household in excess of the stated limitation will be void. All entries become the property of Provider and will not be acknowledged or returned.
Per Instagram rules, this promotion is in no way sponsored, administered, or associated with Instagram, Inc. By entering, entrants confirm that they are 18+ years of age, release Instagram of responsibility, and agree to Instagram’s terms of use.
- Prize Drawing
On or about November 21st, 2022, the Provider will select potential winner in a random drawing from among all eligible entries received. The Provider will attempt to notify the potential winner via telephone or email on or about November 25th, 2022. If the potential winner cannot be contacted within five (5) days after the date of the first attempt to contact him/her, the Provider may select an alternate potential winner in his/her place at random from the remaining non-winning, eligible entries.
7. Winner Notification
The odds of winning depend on the number of eligible entries. The potential winner will be notified after the deadline by email and/or through social media. Each potential Grand Prize winner (parent/legal guardian if a minor in his/her state of residence) will be required to complete, electronically sign and submit a Declaration of Compliance within five (5) days of the date notice or attempted notice is sent, in order to claim his/her prize. If a potential winner cannot be contacted, or prize is returned as undeliverable, potential winner forfeits prize. If the potential winner is at least 18 but still considered a minor in his/her jurisdiction of residence, Provider reserves the right to award the prize in the name of his/her parent or legal guardian. Potential winners must continue to comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all requirements. In the event that a potential winner is disqualified for any reason, Provider will award the applicable prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded. The prize will be fulfilled approximately 8-10 weeks after the conclusion of the Drawing.

9. General Conditions
In the event that the operation, security, or administration of the Drawing is impaired in any way for any reason, including, but not limited to fraud, virus, bug, worm, unauthorized human intervention or other technical problem, or in the event the Drawing is unable to run as planned for any other reason, as determined by Provider in its sole discretion, the Provider may, in its sole discretion, either (a) suspend the Drawing to address the impairment and then resume the Drawing in a manner that best conforms to the spirit of these Official Rules or (b) terminate the Drawing and, in the event of termination, award the prize at random from among the eligible, non-suspect entries received up to the time of the impairment. The Provider reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Drawing or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Any attempt by any person to damage the website or undermine the legitimate operation of the Drawing may be a violation of criminal and civil law, and, should such an attempt be made, the Provider reserves the right to seek damages (including attorney’s fees) and any other remedies from any such person to the fullest extent permitted by law. Failure by the Provider to enforce any provision of these Official Rules shall not constitute a waiver of that provision.
All taxes, fees, assessments, title and registration fees, insurance, and like charges, associated with the receipt or use of a prize are the sole responsibility of the winner.
The value of the prize is based upon good faith estimates by Drawing Providers as of the date the Drawing was commenced. The Drawing Providers assume no responsibility for changes in market conditions that may impact the value of a prize. There is no guaranty that the IRS, or its counterpart in any state’s jurisdiction, will accept the estimated value of any prize for purposes of determining any tax that may be due by the winner.
Extension Of Drawing: At Drawing Provider’s sole discretion and option, the dates for the drawings may be extended by no more than thirty days.
Amendment Of Rules: If, for any reason, the administration, security, fairness, or integrity of the Drawing has been compromised, Drawing Provider reserves the right, exercisable at its sole discretion, to cancel, terminate, modify or suspend the Drawing. The Official Rules may be amended by Drawing Provider in its sole discretion. Amendments will be posted on the Website. Unless otherwise specified, any amendments will become effective at 12:00:01 a.m. CT on the day after they are posted.
Official Rules and the name of the winners may be obtained by sending a self- addressed, stamped envelope to: Imajn Services, LLC dba Sparrow. Indicate “Resident Appreciation Month Giveaway Entry Official Rules Request” or “Resident Appreciation Month Giveaway Entry Winner List” on the outside of the envelope as applicable. Limit one (1) request per envelope. The request must include the name of the Drawing. Participants may also submit questions or request the Official Rules and/or winners list by sending an email detailing their request to CustomerService@sparrownow.com. The Official Rules will be posted at www.sparrownow.com throughout the Drawing.
The Drawing and all of the related pages, contents and code are copyright protected. Copying or unauthorized use of any copyrighted material or trademarks without the express written consent of its owner is strictly prohibited.
10. Release
Participant FULLY RELEASES THE DRAWING PROVIDERS FROM ANY AND ALL LIABILITY, AND WAIVE ALL SUCH LIABILITY, CAUSED BY OR RESULTING FROM THE USE OR POSSESSION OF ANY PRIZE AWARDED OR CAUSED BY OR RESULTING FROM PARTICIPATION IN THE DRAWING OR ANY RELATED PROMOTION. PARTICIPANT UNDERSTANDS AND AGREES THAT IN NO EVENT WILL THE DRAWING PROVIDERS BE LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, STATUTORY OR PUNITIVE DAMAGES ASSOCIATED WITH PARTICIPATION IN THE DRAWING OR USE OF ANY PRIZE. PARTICIPANT FURTHER UNDERSTANDS AND AGREES THAT ANY PRIZE AWARDED IS RECEIVED “AS IS,” WITHOUT ANY WARRANTY OR REPRESENTATION OF ANY KIND FROM DRAWING PROVIDERS, AND THAT ALL SUCH WARRANTIES, INCLUDING WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE, ARE EXPRESSLY DISCLAIMED.
11. Disputes
Except where prohibited, each entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Drawing or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Arizona. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrants rights and obligations, or the rights and obligations of the Provider in connection with the Drawing, shall be governed by, and construed in accordance with, the laws of Arizona, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any jurisdiction other than Arizona.
Regardless of whether a particular dispute is subject to arbitration or litigation, each Party does hereby waive his/her/its right to a trial by jury, to participate as the member of a class in any purported class action or other proceeding, or to name unnamed members in any purported class action or other proceedings.
12. Privacy / Use and License of Information and Submitted Content
Information collected from entrants is subject to Provider’s privacy policy. Notwithstanding any contrary provision in any of the privacy policy, Participant grants to Drawing Provider, and Drawing Provider reserves, the right to use any and all information related to the Drawing, including information and content submitted by Participant in connection with the Drawing, as follows:
(a) Marketing – Participant agrees Drawing Provider may use Participant information for marketing purposes or any other purpose, unless prohibited by law. By submitting your contact information, you agree to allow the Drawing Provider to send you promotional materials and/or offers.
(b) Right of Publicity License – Participant grants Drawing Provider permission to use his/her name, voice, likeness and biographical information for advertising and promotional purposes without compensation.
(c) Intellectual Property License – Participant grants Drawing Provider the non-exclusive, irrevocable, royalty-free, fully-paid, unencumbered, transferable, sub-licensable, perpetual, and universe-wide right, but not the obligation, to reproduce, prepare derivative works based upon, distribute, transmit, publicly perform, publicly display, compile, archive, syndicate and otherwise use and exploit the entry and any content submitted to Drawing Provider (including without limitation copyrights), as well as any and all derivatives thereof, in any and all languages, and in any and all manners, mediums, and forms now known or hereinafter devised.
(d) Warranty – Participant represents and warrants to Drawing Provider that s/he has full legal right, power, and authority to grant the foregoing licenses, and, if applicable, has secured all necessary rights from any subjects depicted in, and/or individuals who contributed to, the entry and content submitted in order to grant such license.
